ATTN Labs provides an Attention Intelligence Layer built on Ethereum, including but not limited to:

• AIM™ (Attention Intelligence Metrics) - Real-time metrics for attention objects
• ENS-based attention object resolution (*.attn.eth)
• Real-time attention flow analytics and visualizations
• API access for developers and integrations
• Whop-based product access and subscriptions

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.

3. User Accounts and Registration

To access certain features of our Services, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

You agree not to use the Services to:

ATTN™, AIM™, and the ATTN Labs logo are trademarks of ATTN Labs. You may not use these trademarks without our prior written consent. See our Trademark Notice for more information.

6. Data and Analytics

Our Services provide access to attention intelligence data and analytics. You acknowledge that:

• Market data and attention metrics are provided for informational purposes only
• We do not guarantee the accuracy, completeness, or timeliness of any data
• Historical performance is not indicative of future results
• You use data at your own risk and should conduct your own research

7. Fees and Payments

Certain Services may require payment. By purchasing any products or subscriptions through our platform or Whop integration, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide accurate billing and payment information
• Authorize us to charge your selected payment method
• Comply with Whop's payment terms and conditions

All fees are non-refundable unless otherwise specified in a separate refund policy or required by applicable law.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Services will be uninterrupted, secure, or error-free
• Any errors or defects will be corrected
• The Services will meet your specific requirements or expectations
• Any data or information obtained through the Services will be accurate or reliable

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATTN LABS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless ATTN Labs and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Services.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website with a new "Last updated" date
• Sending an email notification to the address associated with your account
• Displaying a prominent notice within the Services

Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

12. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for the resolution of any disputes arising from these Terms.
